Entrants will be deemed to have accepted these terms and conditions (“Terms and Conditions”), and agreed to be bound by them, when entering this Promotion and confirming the acceptance of these Terms and Conditions. When can you apply for tickets

  1. Starting date: 11am (CET) on 2 June 2017.
  2. Closing date: 11am (CET) on 26 June 2017.
  3. Any application for tickets received before the Starting Date or after the Closing Date will not be entered into the Promotion. The award of tickets to entrants is not guaranteed.


Who may apply for tickets

  1. The chance to apply for admission tickets to the BACARDÍ No Commission event in Berlin on 29 June (7pm-midnight), 30 June (7pm-midnight) and 1 July 2017 (2pm-8pm) (“Promotion”) is open to residents of Germany aged 18 or over.
  2. The following may not apply for tickets: (a) employees of Promoter or its agents and their first and second degree family members, (b) anyone else who is directly or indirectly professionally connected with the Promotion or the Promoter and their family members, and (c) employees of any company active in the alcoholic beverage sector (and their first and second degree family members).


How to apply for tickets

  1. To take part in this Promotion, entrants must do the following between the Starting and the Closing Date:
    • visit;
    • pass through the age gate and then apply for tickets by signing in or entering your full name, email address, date of birth, choice of event session;
    • tick to confirm that you have read and agree to be bound by these Terms and Conditions and that you have read our Privacy Policy; and
    • click submit.
  2. No purchase is necessary but entrants will need access to the internet at their cost in order to be able to apply for tickets.


Limitations / restrictions on the application for tickets

  1. Maximum of one application per email address.
  2. Entrants are responsible for ensuring they will be able to accept the tickets and to attend the Promotion as set out below and in accordance with these Terms and Conditions. In case the event tickets are awarded to an entrant who is unable to accept the tickets and to attend the Promotion, the Promoter reserves the right to cancel the tickets’ award and to assign the tickets to another eligible entrant using the method set out in the “Tickets award selection and notification” section below (and so on until entrants who are eligible and able to accept the tickets are found).
  3. Applications for tickets must not be made in bulk, or through agents or third parties.
  4. Incomplete applications and applications that do not comply in full with these Terms and Conditions will be disqualified and will not be counted.


Tickets award selection and notification

  1. Due to the maximum total capacity of the BACARDÍ No Commission event venue and due to safety needs, the number of tickets that can be awarded to the Promotion entrants is limited for each of the event session part of the Promotion as follows: Thursday 29th June (between 400 – 700 tickets), Friday 30th June (between 1000 – 1,500 tickets), Saturday 1st July (between 1000 – 1,500 tickets).
  2. The award of tickets will take place on 26 June 2017. Winners for each event session will be drawn at random from all complete, correct and eligible entries received before the Closing Date, and will be notified by email on 26 June 2017 that they have won a ticket to the event session of their choice. On receiving that email notification, entrants must respond by clicking on the link in the notice within 24 hours of it being sent, in order to confirm their acceptance. If, after 24 hours of the first email notification, any tickets have not been allocated through winner acceptance, another random draw will take place to allocate the remaining tickets from the remaining complete, correct and eligible entries received before the Closing Date, the next round of winners will be notified by email on 27 June 2017 that they have won a ticket to the event session of their choice, and the process above will be followed again. This will continue every 24 hours until every ticket has been accepted or until 11:00am on 28 June 2017, whichever is the earlier.
  3. Entrants should ensure they check their spam/bulk/junk folders for notification, because of the time limits described above.
  4. Tickets will be emailed to successful entrants via their registered email address. They can bring paper copies of the tickets or show the email on their phone to gain entry to the event.
  5. Participants to this Promotion and their chosen guest must be 18 or over. Proof of age, identity and eligibility may be required in order to claim the tickets.
  6. Promoter’s decisions are final and binding in all respects on all entrants and no correspondence will be entered into.


Tickets and the event

  1. The admission to the Promotion and the tickets to the event do not include travel costs, personal expenditure and/or other incidental costs for attending the event.
  2. There is no cash alternative to the tickets and they are non-refundable and non-transferable.
  3. The Promoter reserves to remove entrants to the event who are intoxicated and/or behave in an anti-social manner. Entrants and their guests agree to abstain from operating any vehicle for at least 12 hours if at the event they have consumed a quantity of alcohol above the legal limit for driving.



  1. The Promoter is not liable for damage or loss unless it occurs due to its wilful misconduct or negligence. The liability for negligence is restricted to gross negligence. The Promoter shall only be liable for simple negligence in case of an infringement of a duty which is of essence for the proper performance under these Terms and Conditions. In case of simple negligence, damages are restricted to the extent reasonably foreseeable to the Promoter at the beginning of the entry period. The liability under the Product Liability Act as well as for injury to life, body or health and for guarantees remains unaffected. In all other cases the Promoter's liability is excluded on the merits. The same restriction of liability will apply to the Promoter’s associated companies, agents or any other third party involved in the Promotion.
  2. Subject to the restrictions set out in section 24, the Promoter will not be responsible for (and will have no liability in connection with) the following occurrences, to the extent that they occur for reasons beyond the Promoter’s reasonable control:
    • any postponement or cancellation of the Promotion;
    • any changes to prizes or the way in which they can be used or enjoyed;
    • problems with the dispatch or execution of the prizes (including travel to or from any part of the prizes); and
    • any act or default of any third party supplier.
  3. Unless caused by his wilful misconduct or negligence as stipulated in section 24, the Promoter does not accept responsibility for network, computer, hardware or software failures of any kind, which may affect the sending, receipt or processing of your entry or for entries lost, damaged, delayed or unreadable, including loss of entries through technical fault or transmission delays.
  4. If the Promoter has grounds to suspect any entrant or third party of cheating, deception or fraudulent or unsportsmanlike conduct of any kind (including, without limitation, manipulating the promotion, award of ticket(s) or any entry or establishing multiple accounts in order to gain multiple tickets where the number of entries is limited) the Promoter reserves the right (in its sole discretion) to disqualify any entrant, entry or person it reasonably believes to be responsible for, or associated with, such activity.


Personal details and publicity

  1. The Promoter will use each winner’s, and each entrant’s personal details for the purpose of administering this Promotion. Please see the Promoter’s Privacy Policy at for further details.   2. To the extent you have given us your explicit consent, we and our agents of Wasserman Experience Limited may contact you via e-mail for marketing and post research survey purposes specified in the respective opt-in at the time of registration.

Your attendance at the event is deemed to amount to your express consent to being filmed or photographed at the event and to our use of such filming, photography, recording, photo or likeness free of charge throughout the world for the purpose to promote the BACARDÍ No Commission event and similar events within Social Media, on websites, on television and in printed materials.


Promoter’s intellectual property

  1. All intellectual property and database rights, in the Promotion, excluding so-called “user generated content” but including, without limitation, trademarks, designs, logos, text, images, audio and video materials, look and feel and software (including code, interface and website structure) (“Materials”) are owned by the Promoter (or its subsidiaries, affiliates, agents or partners).
  2. The Materials are protected by intellectual property laws and treaties around the world.
  3. All such rights are reserved and it is strictly prohibited to remove any copyright or other proprietary notices from any Materials.


German law applies

  1. This Promotion, and any dispute or claim arising out of or in connection with it (including the tickets’ award), shall be governed by and construed in accordance with German law - except for any dispute arising due to the use of the entrants’ personal data according to clause 28 which shall be governed by the laws of England - and entrants irrevocably agree that the courts of Germany shall have exclusive jurisdiction to settle any such dispute or claim.
